Bankruptcy & Receivership
Chapter 11 - Reorganization
A business with more debt than it can pay still has options. We guide clients through the full reorganization process: bankruptcy plans, claim treatment and negotiations, and section 363 sales. We represent secured lenders, franchisors, unsecured creditors, and institutional stakeholders in contested Chapter 11 proceedings.
Creditors' Rights
We pursue creditor claims, including filing proofs of claim, challenging dischargeability, bringing preference and fraudulent transfer actions, and seeking relief from the automatic stay.
When a business is in financial trouble, the lawyer you choose affects how much you recover or lose. Our attorneys have handled large bankruptcy and receivership matters for years. We run a lean practice utilizing the latest technological advances, which keeps our clients' costs down.
Court-Appointed Receiverships
We represent parties on all sides of receivership actions, including lenders, creditors, and other parties seeking court appointment of a receiver or needing representation. We will also serve as counsel to receivers, advising on the scope of the appointment, asset preservation, third-party disputes, and estate administration.
Out-of-Court Workouts
Not every restructuring needs a court process. We structure private debt restructurings, forbearance agreements, and consensual asset dispositions that often resolve financial distress faster, and for less, than formal proceedings.
